We reserve the right to refuse any order placed with us and may limit or cancel quantities purchased per person, household, or order, and prohibit orders that appear to be placed by dealers, resellers, or distributors.

In the event we cancel or change your order, every attempt will be made to notify you by using the contact information you have provided at the time of purchase.  You agree to provide complete and accurate information at the time of your purchase and agree to update your account and any other information needed to complete your purchase, for us to complete your order or transaction, or contact you if necessary.

SHIPPING AND DELIVERY:

The Broken Picket ships items within 3-7  business days.  At this time The Broken Picket only ships to locations in the United States.  The risk of loss and title for all products ordered on this Site passes to You when the product is delivered to the shipping carrier.

SALES TAX

The Broken Picket charges sales tax for products ordered on this Site based on applicable state sales tax rates and locations to which the order is being shipped.

THIRD-PARTY LINKS TO OTHER WEBSITES

COMMENT AND FEEDBACK LIABILITY

You agree that your feedback and comments will not violate any right of any person or third party.  You agree to not violate copyright, trademark, privacy, personality, or other personal or proprietary rights.  Additionally, you agree that your comments will be void of libelous, abusive, obscene,  or unlawful, material.  You also agree to not make comments that contain third-party links that may contain any type of computer virus or other malware that could affect the operation of the Site or other Site users.

The Broken Picket assumes no responsibility and will assume no liability for any comments posted by you or any third party.  We maintain the right to at any time monitor, edit, or remove posted content that we determine to be unlawful, misleading, offensive, libelous, defamatory, threatening, obscene, or that may violate any party's intellectual property or person, and/or the Terms of Service to which you have agreed, or without limitation, if The Broken Picket believes that the customer conduct is harmful to the interests of The Broken Picket.

It is prohibited to provide a false e-mail, address, or phone number, or pretend to be someone other than yourself.  You are solely responsible for any comments you make and take full responsibility for any liability, abuse, or damages that may occur. 

LIMITATION ON LIABILITY

The Broken Picket is not liable for any damages that may occur to you as a result of your misuse of our Site.  

The failure of The Broken Picket to exercise or enforce any right or provision within the Terms and Conditions shall not constitute a waiver of any rights or provisions.  Any damages that You might incur, the entire liability of The Broken Picket under the provision of these terms, and Your exclusive remedy for all the foregoing shall be limited to the amount actually paid by You.

We reserve the right to claim products and services "AS IS" and will not make additional provisions for replacements unless warranted or deemed applicable.

The Broken Picket reserves the right to edit, modify, update, and change the Terms and Conditions at any time by updating our website with the changes and the change date.  It is your responsibility to periodically check the Site for any and all said changes and updates.  Continued use of our services through the Site after changes or updates have been made, establishes acceptance of any new or updated Terms and Conditions changes.  This Agreement is an understanding between The Broken Picket and the user, and this supersedes and replaces all prior agreements regarding the use of this Site.

If we suspect or find that you have failed to follow or comply with the Terms and Conditions, as outlined above, we may terminate the agreement at any time without notice.  We will not refund or prorate any unused portion of products or services, and you will remain liable for the full amounts due up to and including through the date of Termination.  We may at any time deny you access to our services and products.
